CONSTRUCTION LAW AS THE BACKGROUND OF DEFECTIVE RULES AND PROCEDURES ATTENDANT CONSTRUCTION DEVELOPMENT

Abstract:

Existing regulations do not provide the right conditions for the development of the construction industry. We
are currently dealing with a number of negative phenomena, mainly related to over-regulation of this pro cess.
Instead of further obstructions, it was stated that changes of the whole system are nessesary. They have to be
introduced by the obligations of the municipalities to adopt the local law, extending the scope of this law to
study the conditions and directions of the spatial development, regulating the issue of communication services
of real estate. Weak administrative procedures as well as bad administrative practices, involving both the
procedures themselves and the application of the rules, also have a significant and negative impact on the investment.
An analysis of the defect of the applicable law and the procedures resulting therefrom. Investment
phases, such as business and location analysis, acquisition of property, acquisition decisions, and conceptual
reconciliation were taken into account.
